President Biden introduced recently an ambitious immigration initiative that will provide legal status and a more accessible path to U.S. residency and citizenship for approximately 500,000 unauthorized immigrants who are married to U.S. citizens.

Mr. Biden’s new program is expected to pave the way to permanent residency, known as a Green Card, and ultimately to U.S. citizenship for many of its beneficiaries. If upheld in court, the policy would be the government’s largest program to protect undocumented immigrants since DACA.
An immigrant who marries a U.S. citizen is generally eligible for a Green Card. However current federal law requires immigrants who entered the U.S. illegally to leave the country and re-enter legally to be eligible for a Green Card. Leaving the country after having lived illegally in it for certain periods of time can trigger a 10-year ban, leading many mixed-status families to avoid this process.

The Biden administration’s policy would allow eligible immigrants to obtain a Green Card without having to leave the U.S. After 5 years of living in the United States as Green Card holders, immigrants can apply for U.S. citizenship.
The president lashed out at his predecessor and 2024 opponent, insisting that the United States can secure the border and offer pathways to citizenship.
“The Statue of Liberty is not a relic of American history,” Biden said. “It represents, it still represents, who we are. But I also refuse to believe that for us to remain the United States that welcomes immigration, we have to give up securing our border. These are false choices. We can secure the border and offer legal pathways to citizenship. We have to recognize that the patience and goodwill of the American people are being tested by their fears at the border. They don’t understand many things. These are the fears my predecessor tries to exploit.”
